Homicide spreads like infectious disease

ScienceDaily (Nov. 29, 2012) ? Homicide moves through a city in a process similar to infectious disease, according to a new study that may give police a new tool in tracking and ultimately preventing murders.

Using Newark, N.J., as a pilot case, a team of Michigan State University researchers led by April Zeoli successfully applied public health tracking methods to the city's 2,366 homicides between 1982 and 2008. They found the killings were not randomly located but instead followed a pattern, evolving from the city's center and moving southward and westward over time.

Like a flu bug that spreads to susceptible groups such as children and the elderly, homicide clusters in Newark -- often fueled by gangs and guns -- spread to areas consisting largely of poor and minority residents. Over time, the concentration of homicides effectively disappeared from one area and settled in another.

"By using the principles of infectious disease control, we may be able to predict the spread of homicide and reduce the incidence of this crime," said Zeoli, public health researcher in MSU's School of Criminal Justice.

The study is one of the first to use analytic software from the field of medical geography to track long-term homicide trends. Zeoli said the method can be done in real time which would allow police to identify emerging hotspots.

The researchers also identified areas of Newark that had no homicide clusters during the 26-year time frame of the study, despite being surrounded by deadly violence.

"If we could discover why some of those communities are resistant," Zeoli said, "we could work on increasing the resistance of our communities that are more susceptible to homicide."

Joining Zeoli on the study were criminal justice researchers Jesenia Pizarro and Christopher Melde and medical geographer Sue Grady.

The study is published in Justice Quarterly, a research journal.

Rhino killings for horns rapidly rise in S. Africa

(AP) ? By the time ranchers found the rhinoceros calf wandering alone in this idyllic setting of scrub brush and acacia, the nature reserve had become yet another blood-soaked crime scene in South Africa's losing battle against poachers.

Hunters killed eight rhinos at the private Finfoot Game Reserve inside the Vaalkop Dam Nature Reserve this month with single rifle shots that pierced their hearts and lungs. The poachers' objective: the rhinos' horns, cut away with knives and popped off the dead animals' snouts for buyers in Asia who pay the U.S. street value of cocaine for a material they believe cures diseases.

That insatiable demand for horns has sparked the worst recorded year of rhino poaching in South Africa in decades, with at least 588 rhinos killed so far, their carcasses rotting in private farms and national parks. Without drastic change, experts warn that soon the number of rhinos killed will outpace the number of the calves born ? putting the entire population at risk in a nation that is the last bastion for the prehistoric-looking animals.

"This is a full-on bush war we are fighting," said Marc Lappeman, who runs the Finfoot reserve with his father Miles and has begun armed vigilante patrols to protect the remaining rhinos there. "We here are willing to die for these animals."

Unchecked hunting nearly killed off all the rhinos in southern Africa at the beginning of the 1900s. Conservationists in the 1960s airlifted rhinos to different parts of South Africa to spread them out. That helped the population grow to the point that South Africa is now home to some 20,000 rhinos ? 90 percent of all rhinos in Africa.

From the 1990s to 2007, rhino poachings in South Africa averaged about 15 a year, according to a recent report by the wildlife trade monitoring network TRAFFIC. In 2008, however, poachers killed 83 rhinos and by 2009, the number hit 122, the report says.

The killings grew exponentially after that: 333 in 2010, 448 in 2011 and as of Tuesday, at least 588 rhino killed this year alone, according to South Africa's Department of Environmental Affairs.

"That the year-on-year rhino poaching losses have continued to grow in the face of heightened awareness, constant media attention and concerted law enforcement effort is testament to just how pervasive and gripping the rhino crisis in South Africa has become," TRAFFIC wrote in its August report. "If poaching continues to increase annually as it has done since 2007, then eventually deaths will exceed births and rhino numbers in South Africa will start to fall."

Most of the killings, according to government statistics, occur in South Africa's massive Kruger National Park, covering 19,400 square kilometers (7,500 square miles) in the country's northeast abutting its borders with Mozambique and Zimbabwe. There, the impoverished slip across the park's borders, largely from Mozambique, to kill and dehorn rhino, earning the equivalent of months' wages in a single night of hunting. South Africa has deployed soldiers in the park with dogs to sniff out poachers, but their small force can't sufficiently cover a park that's roughly the same size as New Jersey.

The horns are sold by criminal gangs and smuggled into Asia. While poachers have been shot dead and hundreds of suspects arrested this year, the rhino killings continue unstopped largely because the trade is transnational and worth millions of dollars, said Julian Rademeyer, a journalist in South Africa who wrote "Killing for Profit," a book on rhino poaching that came out this month.

"The problem with law enforcement strategies is they end where our border ends," Rademeyer said.

And law enforcement can't always be trusted in South Africa, where corruption eats away at the nation. There have been several cases of rangers assigned to guard parks being arrested for aiding poachers.

With both South Africa and Swaziland allowing rhino to be hunted legally, criminal gangs have obtained hunting licenses under false pretenses. Gangs have hired prostitutes and the poor from Asia and Eastern Europe to pose as big game hunters with licenses to kill a single rhino apiece, Rademeyer said. Their "trophies" end up shipped back to Asia, where the horns are removed and sold.

Rhino horn is made of keratin, a tough protein found in human fingernails. Doctors have repeatedly said the material has no medical value. In Asia, however, demand for rhino horn has jumped dramatically. Experts blame it partly on a widespread rumor in Vietnam that rhino horn cures cancer, though some elite Vietnamese grind up horn and take it as a hangover cure or as a fever reducer.

The ever-increasing demand saw Vietnamese poachers kill the last of Vietnam's rare Javan rhinoceros last year for its horn. The World Wildlife Fund ranked Vietnam as the worst country for wildlife crime in Asia and Africa in July. The country is seen as having lax laws on importing horns. Diplomats at the Vietnamese Embassy in South Africa's capital Pretoria have also been linked to trafficking. Earlier this month, a South African court sentenced a Thai national to 40 years in prison for selling rhino horns.

With high-level officials involved and a strong demand, Rademeyer said poaching "will probably get a lot worse before it gets any better."

Rhino poachers have gone beyond Kruger and are targeting private farms and reserves. Poachers likely watched the Finfoot Game Reserve, which breeds rhino for game viewing, for days, Lappeman said. Workers caught a man in ragged clothes lurking around the park with more than 1,000 rand ($115) in crisp hundred rand bills and a new mobile phone in his pocket around the time of the killings, Lappeman said.

The poachers fired on the rhino far from the game lodge, probably moving methodically closer as no one came to investigate the shots, he said. Lappeman said he and his father only found the dead rhinos the day after seeing the lost calf.

One wounded mother rhino walked all the way to the property's edge, finally dying on a dirt road to be found first thing that morning.

"She had physically come to the road to die, to say, 'I'm dying, come fetch my calf,'" Lappeman said.

Lenovo's quietly introduced IdeaPhone P770 at least theoretically challenges its American counterpart by cramming a 3,500mAh lithium polymer battery into a thicker 11.9mm (0.47-inch) body. That's 200mAh more than Motorola's energy champion, and enough for the company to flaunt a 29-hour talk time. That's not quite as long as Motorola's claimed 32 hours, but Lenovo has done something its American rival seemingly can't -- launch a phone with Jelly Bean. Motorola might rest easier in knowing that the the P770 is an unrepentantly budget-focused behemoth, carrying a 4.5-inch qHD display, a (possibly MediaTek-made) 1.2GHz dual-core processor, 4GB of built-in storage, an 8GB microSD card and both 5-megapixel rear as well as VGA front cameras. For the ¥1,699 ($273) Lenovo is asking for an off-contract model in its native China, the P770 could still be the first pick of many local phone owners on long-haul trips. It's just a shame that the lack of 4G (and Lenovo's domestic-first mobile strategy) likely means we won't see a launch in the US.

BLOOMINGTON, Ind. (AP) ? No. 1 Indiana had something to prove Tuesday night ? that it could play defense.

Just two days after the Hoosiers put together their best game this season, they delivered an even more impressive performance, getting 20 points from Cody Zeller and 19 each from Will Sheehey and Victor Oladipo, running away from No. 14 North Carolina 83-59 in the ACC-Big Ten Challenge.

"Our guys played great basketball tonight," coach Tom Crean said. "We played against an incredible opponent, everybody understands how great North Carolina is. Our guys had an edge to them tonight, and it was on the defensive end as much as anything else."

The conventional wisdom is that the Hoosiers (7-0) are one of the nation's top scoring teams.

But the detractors have questioned Indiana's willingness to defend and some have even suggested that weakness has allowed No. 2 Duke to close the gap on the nation's top-ranked team.

North Carolina coach Roy Williams disagrees.

"I think they are," he said when asked whether Indiana deserved to be No. 1. "The thing I like about them is they really are a team. They don't have one guy that beats you up, they beat you so many different ways."

Williams and the Tar Heels (5-2) learned that lesson the hard way in Bloomington.

In the second half, the Tar Heels shot just 27.8 percent from the field and went 0 for 5 from 3-point range. They were outscored 12-8 on the fast break, an area that had caused so much concern for Crean that he lost sleep leading up to the game.

"I know people criticize us for our defense, and they say 'If they can't play defense, how good can they really be?'" Oladipo said.

Offensively, the Hoosiers were their usual balanced selves.

Zeller was 8 of 13 from the field with four blocks, one steal and an assist. Oladipo and Sheehey were both 8 of 12 from the field. Senior guard Jordan Hulls was 5 of 8, including three 3-pointers, and finished with 13 points, eight assists and two steals.

"It's cool," Oladipo said when asked about beating a program like North Carolina this handily. "I mean, we've been working really hard and you guys know as well as I know that this program, well not last year, but over the last couple of years was really struggling and we wanted to get it back to where it belongs, which is on top. So to get a win like that, it's a humbling experience."

The best thing about this game for North Carolina may be the end of its run against teams from the Hoosier State.

A week ago, North Carolina trailed by 29 points in the second half before falling 82-71 to two-time national runner-up Butler.

On Tuesday, it was almost an instant replay.

Indiana closed the first half fast, started the second half fast and spent the rest of the game pulling away. The Hoosiers' biggest lead, 83-51, came with 4:22 left in the game.

Dexter Strickland led the Tar Heels with 14 points, Marcus Paige had 11 and James Michael McAdoo had 10 points and nine rebounds for North Carolina, which was missing sophomore guard P.J. Hairston, who stayed home with a sprained left knee.

There was a bigger problem, though. North Carolina couldn't figure out how to contain Zeller, one of this season's favorites to be the national player of the year.

"Boy, I would love to watch them play if it wasn't against my team," Williams said. "You look down the lineup and Cody Zeller, he's family to begin with, he's really a load to handle, and two other guys that I didn't even hear of when they were in high school, they just kicked our rear ends."

The game pitting two of the country's most storied programs ? which have combined for 10 national titles and 3,767 wins ? had been billed as one of this season's showcase events. For 16 minutes, it lived up to the hype.

Zeller changed everything with two flurries.

By setting high picks and drawing post players outside, it opened up the lanes for his cutting and slashing teammates who wasted no time exploiting the holes in the Carolina defense, using a 15-6 run at the end of the first half to take a 46-37 halftime lead.

The Hoosiers were only getting started.

"If you let them dictate and control the pace of the game, they're going to win," Crean said. "So we had to control and dictate the pace of the game, and to do that, we had to run."

But in the second half, the Hoosiers were out to prove something else ? that they could defend.

Over the first 8? minutes, North Carolina managed only three points, the tip-in and a free throw.

Zeller and Oladipo, meanwhile, combined for seven points in the opening 13-0 blitz that put Indiana ahead 59-37, and North Carolina never challenged again as the Hoosiers won their 34th consecutive home game in November against a team that was supposed to cause havoc.

"It's a huge statement," Sheehey said. "We prepared for this game for a couple of weeks now and that's about it. You saw the score. We played hard, we played well, we played together and when we do that, stuff is going to happen."

Lenny Kravitz to play Marvin Gaye in biopic

NEW YORK (AP) ? Lenny Kravitz has signed on for his first leading film role, playing singer Marvin Gaye in a biopic that will be shot next year.

The rocker's publicist Carleen Donovan confirmed the news Tuesday. Kravitz has played supporting roles in the past, including a small part in "The Hunger Games."

Rolling Stone first reported details about the 48-year-old performer's part in the film, directed by Julien Temple.

The magazine says the "Are You Gonna Go My Way" singer will portray Gaye during the 1980s when he was fighting his addictions and attempting to restart his career. Gaye died in 1984 after being shot by his father.

Bitter struggle over Internet regulation to dominate global summit

An unprecedented debate over how the global Internet is governed is set to dominate a meeting of officials in Dubai next week, with many countries pushing to give a United Nations body broad regulatory powers even as the United States and others contend such a move could mean the end of the open Internet.

The 12-day conference of the International Telecommunications Union, a 157-year-old organization that's now an arm of the United Nations, largely pits revenue-seeking developing countries and authoritarian regimes that want more control over Internet content against U.S. policymakers and private Net companies that prefer the status quo.

Many of the proposals have drawn fury from free-speech and human-rights advocates and have prompted resolutions from the U.S. Congress and the European Parliament, calling for the current decentralized system of governance to remain in place.

While specifics of some of the most contentious proposals remain secret, leaked drafts show that Russia is seeking rules giving individual countries broad permission to shape the content and structure of the Internet within their borders, while a group of Arab countries is advocating universal identification of Internet users. Some developing countries and telecom providers, meanwhile, want to make content providers pay for Internet transmission.

Fundamentally, most of the 193 countries in the ITU seem eager to enshrine the idea that the U.N. agency, rather than today's hodgepodge of private companies and nonprofit groups, should govern the Internet. The ITU meeting, which aims to update a longstanding treaty on how telecom companies interact across borders, will also tackle other topics such as extending wireless coverage into rural areas.

If a majority of the ITU countries approve U.N. dominion over the Internet along with onerous rules, a backlash could lead to battles in Western countries over whether to ratify the treaty, with tech companies rallying ordinary Internet users against it and some telecom carriers supporting it.

In fact, dozens of countries including China, Russia and some Arab states, already restrict Internet access within their own borders, but those governments would have greater leverage over Internet content and service providers if the changes were backed up by international agreement.

Amid the escalating rhetoric, search king Google last week asked users to "pledge your support for the free and open Internet" on social media, raising the specter of a grassroots outpouring of the sort that blocked American copyright legislation and a global anti-piracy treaty earlier this year.

Google's Vint Cerf, the ordinarily diplomatic co-author of the basic protocol for Internet data, denounced the proposed new rules as hopeless efforts by some governments and state-controlled telecom authorities to assert their power.

"These persistent attempts are just evidence that this breed of dinosaurs, with their pea-sized brains, hasn't figured out that they are dead yet, because the signal hasn't traveled up their long necks," Cerf told Reuters.

The ITU's top official, Secretary-General Hamadoun Tour?, sought to downplay the concerns in a separate interview, stressing to Reuters that even though updates to the treaty could be approved by a simple majority, in practice nothing will be adopted without near-unanimity.

"Voting means winners and losers. We can't afford that in the ITU," said Tour?, a former satellite engineer from Mali who was educated in Russia.

Tour? predicted that only "light-touch" regulation on cyber-security will emerge by "consensus," using a deliberately vague term that implies something between a majority and unanimity.

He rejected criticism that the ITU's historic role in coordinating phone carriers leaves it unfit to corral the unruly Internet, comparing the Web to a transportation system.

"Because you own the roads, you don't own the cars and especially not the goods they are transporting. But when you buy a car you don't buy the road," Tour? said. "You need to know the number of cars and their size and weight so you can build the bridges and set the right number of lanes. You need light-touch regulation to set down a few traffic lights."

Because the proposals from Russia, China and others are more extreme, Tour? has been able to cast mild regulation as a compromise accommodating nearly everyone.

Two leaked Russian proposals say nations should have the sovereign right "to regulate the national Internet segment." An August draft proposal from a group of 17 Arab countries called for transmission recipients to receive "identity information" about the senders, potentially endangering the anonymity of political dissidents, among others.

A U.S. State Department envoy to the gathering and Cerf agreed with Tour? that there is unlikely to be any drastic change emerging from Dubai.

"The decisions are going to be by consensus," said U.S. delegation chief Terry Kramer. He said anti-anonymity measures such as mandatory Internet address tracing won't be adopted because of opposition by the United States and others.

"We're a strong voice, given a lot of the heritage," Kramer said, referring to the U.S. invention and rapid development of the Internet. "A lot of European markets are very similar, and a lot of Asian counties are supportive, except China."

Despite the reassuring words, a fresh leak over the weekend showed that the ITU's top managers viewed a badly split conference as a realistic prospect less than three months ago.

The leaked program for a "senior management retreat" for the ITU in early September included a summary discussion of the most probable outcomes from Dubai, concluding that the two likeliest scenarios involved major reworkings of the treaty that the United States would then refuse to sign. The only difference between the scenarios lay in how many other developed countries sided with the Americans.

ITU officials didn't dispute the authenticity of the document, which was published by Jerry Brito, a researcher at the Mercatus Center at George Mason University as part of a continuing series of ITU-related leaks.

Tour? said that because the disagreements are so vast, the conference probably will end up with something resembling the ITU's earlier formula for trying to protect children online ? an agreement to cooperate more and share laws and best practices, perhaps with hotlines to head off misunderstandings.

"From Dubai, what I personally expect is to see some kind of principles saying cyberspace is a global phenomenon and it can only have global responses," Tour? said. "I just intend to put down some key principles there that will lay the seeds for something in the future."

Even vague terms could be used as a pretext for more oppressive policies in various countries, though, and activists and industry leaders fear those countries might also band together by region to offer very different Internet experiences.

In some ways, the U.N. involvement reflects a reversal that has already begun.

The United States has steadily diminished its official role in Internet governance, and many nations have stepped up their filtering and surveillance. More than 40 countries now filter the Net that their citizens see, said Ronald Deibert, a University of Toronto political science professor and authority on international conflicts in cyberspace.

Google Executive Chairman Eric Schmidt said this month that the Net is already on the road to Balkanization, with people in different countries getting very different experiences from the services provided by Google, Skype and others.

This month, a new law in Russia took effect that allows the federal government to order a website offline without a court hearing. Iran recently rolled out a version of the Internet that replaced the real thing within its borders. A growing number of countries, including China and India, order sites to censor themselves for political, religious and other content.

China, which has the world's largest number of Internet users, also blocks access to Facebook, YouTube and Twitter among other sites within its borders.

The loose governance of the Net currently depends on the non-profit ICANN, which oversees the Web's address system, along with voluntary standard-setting bodies and a patchwork of national laws and regional agreements. Many countries see it as a U.S.-dominated system.

The U.S. isolation within the ITU is exacerbated by it being home to many of the biggest technology companies???and by the fact that it could have military reasons for wanting to preserve online anonymity. The Internet emerged as a critical military domain with the 2010 discovery of Stuxnet, a computer worm developed at least in part by the United States that attacked Iran's nuclear program.

Whatever the outcome in Dubai, the conference stands a good chance of becoming a historic turning point for the Internet.

"I see this as a constitutional moment for global cyberspace, where we can stand back and say, `Who should be in charge?' said Deibert. "What are the rules of the road?"

On average the Stones older than US Supreme Court

NEW YORK (AP) ? The Supreme Court used to be called Nine Old Men. That's nothing compared to the ageless Rolling Stones. The justices on average are the kid brothers and sisters of the forever young rock n' rollers.

The average age for the four living members of The Rolling Stones is about two years older than the nine justices of the U.S. Supreme Court.

Mick Jagger, Keith Richards, Charlie Watts and Ronnie Wood have an average age of 68 years and 297 days, while the Supreme Court justices' average is 66 years and 364 days. That makes the rock band one year and 10 months older than the members of the highest court of the United States.

The Rolling Stones are celebrating their 50th anniversary this year with a five-date tour in New York, New Jersey and London, where the first show kicked off Sunday night.

President Mahama says only NDC has a cogent programme on ...

President John Dramani Mahama says it is only the National Democratic Congress (NDC) that has a cogent programme on education which links up the various levels on the educational ladder.

He said the NDC planned to expand access at the basic level, secondary and tertiary levels.

President Mahama was addressing students of the Koforidua Polytechnic who cheered him on as he addressed them.

President Mahama, who is the Presidential candidate of the NDC for the 2012 election, had earlier addressed rallies at Atimpoku, Odumase Krobo, Adukrom, Adawso and Begoro.

People lined up the streets in all the areas to catch a glimpse of the President and cheer him on. Some among the crowd danced ?Azonto? to the NDC?s songs.

The President said the next NDC government would continue with efforts to make basic education truly free and universal and take steps to make SHS progressively accessible and free.

He said the next NDC government would build 200 community senior high schools (SHS) to accommodate more students from the Junior High Schools (JHS).

Besides, he said, the government would put up 10 colleges of education, build more vocational and technical schools, build more nursing and midwifery training colleges and establish one public university in the Eastern Region.

The President said the expansion of facilities at the various levels of the educational ladder would allow students to progress from one stage of the educational ladder to the other without any hitches.

On polytechnic education, he said the next NDC government would improve faculties and expand infrastructure at the various polytechnics to make it possible for the polytechnics to award their own degrees.

Under that arrangement, he said polytechnic students would be able to acquire their own degrees without affiliation to any universities.

President Mahama said the NDC could be trusted to deliver on its promises because it had a track record of delivery.

For instance, he said, it was the first NDC government that established the University of Education, Winneba, the University of Mines and Technology, Tarkwa, and the University for Development Studies (UDS) in the north.

Besides, he said, the previous NDC government established 119 SHS, seven polytechnics and several vocational and technical schools.

The President said the current NDC government has established the University of Health and Allied Sciences in the Volta Region and the University of Energy and Natural Resources in the Brong Ahafo Region, indicating that both universities had just matriculated their first batches of students.

He, therefore, asked Ghanaians to discount the NPP?s proposed free SHS since it was a m ere political gimmick to get Ghanaians into voting for the party.

President Mahama contended that the NDC government?s performance in the areas of education, healthcare, economy and infrastructure development in the last four years had been remarkable.

He said the NDC government used the period to lay the foundation.

Therefore, he said, it was crucial for Ghanaians to renew the mandate of the NDC to build on what it had started.

Wall Street isn't backing Jack Lew for Treasury - Fortune Finance ...

FORTUNE -- Jack Lew, the frontrunner to be named Treasury Secretary in Obama's second term, isn't Wall Street's first choice for the key economic post. He's not even its second.

"I've talked to a bunch of investors and it's seen as a net negative going from [Tim] Geithner to Lew," says Chris Krueger, senior political analyst at Guggenheim Partners. "Who does Wall Street want? Not Jack Lew."

Lew,?57, spent three years on Wall Street working at Citigroup (C) as the chief operating officer of its alternative asset investment management unit. One of the funds Lew's group invested in was run by John Paulson, who at the time was betting heavily against the housing markets and banks. But that's not the part of Lew's resume that anyone seems to remember. And it's certainly not the important part.

After Lew, a Queens, New York native, graduated from Harvard University and Georgetown Law, he headed straight to Washington and has mostly stuck inside the Beltway ever since. He's been on teams credited with brokering major budget deals. He worked for Tip O'Neill when the House speaker struck a deal to raise taxes and cut benefits with President Reagan. And Lew was a key member of President Clinton's budget team, which simultaneously erased the deficit and struck a long-term deal with Republicans to preserve entitlements.

Under Obama, Lew served as the head of the Office of Budget and Management, and a year ago he became Obama's chief of staff.

Since the election Obama has seemingly been trying to patch things up with Wall Street, which threw its collective support behind Romney. After the election, Obama called JPMorgan Chase (JPM) CEO Jamie Dimon and other business leaders. And Lew recently met with Dimon to talk about the fiscal cliff. Geithner is expected to exit the Treasury job early next year.

Nonetheless, some financial executives say that if Obama were to choose Lew for Treasury Secretary, it would signal that the president is not as serious about mending his relationship with corporate leaders as he says. Wall Streeters say the two other candidates who are considered in the mix for the job, former investment banker and two-time second Erskine Bowles and BlackRock (BLK) CEO Larry Fink, would be preferable to Lew. Bowles has been a deficit hawk, and Fink clearly knows the debt market. What's more, unlike Lew, neither one would need an introduction to Wall Street.

Don Marron, a dean of Wall Street who was also once rumored to be a top pick for the Treasury Secretary job (under a Bob Dole presidency in 1996), says he doesn't know Lew, or where he stands on business issues. And Marron?says that will be a problem for corporate America and the market. "Lew will be more of an unknown at a time when you don't want unknown," he says.

Strangely enough, Democrats don't seem so excited about Lew either. They don't think he will be tough enough on Wall Street. And by picking Lew, who has little background in regulating financial markets, Obama would signal that he is more focused right now on striking a budget deal, and less focused on further tinkering with the rules on Wall Street.

Lew wouldn't be the first Treasury Secretary to come from more of a political background instead of Wall Street or corporate America. James Baker, for instance, served as the Treasury Secretary during Reagan's second term.?But the relationship between the Treasury Secretary and Wall Street matters more than it used to. One of the legacies of Tim Geithner, who is a lifetime regulator, has been to focus the position more on market regulation. The Treasury Secretary is now the head of the Financial Stability Oversight Council, the newly formed team of regulators that is supposed to be on the lookout for risks that could cause future crises. And the relationship between the economy and the market's performance is much closer than it was back in Baker's day.

So some of this can be dismissed as more Masters of the Universe griping they are not being heard by Obama. But not all of it.

Four Major Variables that Determine Market Price

Over the last two days we looked at the four main variables that determine home price:

  1. borrower income,
  2. allowable debt-to-income ratios,
  3. interest rates, and
  4. down payment requirements.

Today we are looking at some of the minor cost inputs that work by influencing the major ones; property taxes and Mello Roos taxes, HOAs, and insurance.

PITI

lenders have an acronym called PITI, which stands for principal, interest, taxes, and insurance.To that we can add HOA dues and other known costs. When people qualify for a loan, the difference between what their income can support and the payment they can make to the lender is a number of related expenses that only homeowners must pay; property taxes, special assessments and Mello Roos, insurance and homeowners associations. These expenses (1) reduce your payment to the lender, (2) reduce the amount you can borrow and bid, and thereby (3) reduce the value of real estate.

Property Taxes

Property taxes have long been a source of local government tax revenues. Real property cannot be moved out of a government?s jurisdiction, and values can be estimated by an appraisal, so it is a convenient item to tax. In most states, local governments add up the cost of running the government and divide by the total property value in the jurisdiction to establish a millage tax rate. California is forced to do things differently by Proposition 13 which effectively limits the appraised value and total tax revenue from real property. Local governments are forced to find revenue from other sources.

Proposition 13 limits the tax rate to 1% of purchase price with a small inflation multiplier allowing yearly increases. In California, the first half of regular secured property tax bills are due November 1st, and delinquent after December 10th; the second half are due February 1st, and delinquent after April 10th each year. If the delinquent date falls on a Saturday, Sunday, or government holiday, then the due date is the following business day.

Often the lender will compel the borrower to include extra money in the monthly payment to cover property taxes, homeowners insurance, and private mortgage insurance, and these bills will be paid by the lender when they come due. If these payments are not escrowed by the lender, then the borrower will need to make these payments. I am a fan of impound accounts because the tiny amount of extra interest you may make saving in your own account is not worth the hassle.

Due to Proposition 13, the property tax bill is very easy to calculate; take one percent of the purchase price. Divide it by twelve to get the monthly cost.

Automatic re-assessment for cash-out refinancing

An idea emerged from the aftermath of the housing bubble; limit HELOC abuse by making cash-out refinancing in excess of the original purchase price an event that triggers property tax re-assessment. The effect is to drive up the cost of borrower money and discourage the behavior. It would probably be very effective.

The lenders would cry foul, and in particular there may need to be an exception for reverse mortgages to accommodate seniors (I think reverse mortgages are a bad idea, but forcing retired people to leave their homes is probably worse). Despite the resistance, the legislation if passed would curtail HELOC abuse, but in an economy dependent upon Ponzi Scheme financing, such legislation is unlikely; although, if the budget shortfall gets bad enough, everything will be on the table. Municipalities would love the idea because their revenues would grow as long as there are Ponzis.

Mello Roos Taxes

In our reports, we classify these as other taxes and assessments because Mello Roos fees are paid through your tax bill. To understand how this became a tax you pay, a brief overview of the Community Facilities District Act is in order (What is Mello Roos?.pdf). From Wikipedia:

A Mello-Roos District is an area where a special property tax on real estate, in addition to the normal property tax, is imposed on those real property owners within a Community Facilities District. These districts seek public financing through the sale of bonds for the purpose of financing public improvements and services. These services may include streets, water, sewage and drainage, electricity, infrastructure, schools, parks and police protection to newly developing areas. The tax paid is used to make the payments of principal and interest on the bonds.

Mello-Roos is deductible in some cases but not in others.

That is the textbook version, now I will give you mine. Imagine you are a real estate developer, and you have a parcel of land that would be worth $10,000,000 if it had infrastructure installed; unfortunately, you do not have the money to install this infrastructure and wait for the investment to come back to you in land or home sales.

What if you could take out a 30-year mortgage on your infrastructure improvements and borrow the money? Now you can finance the deal and develop the land, but there is still a problem. How do you get the homeowner to pay off the infrastructure mortgage after they buy the house?

The solution elected officials came up with was to create a special tax district so the repayment of the bonds to fund the infrastructure is bumped up the payment priority list. In short, you can?t avoid paying Mello Roos, or the tax man will be after you, and he has the power of foreclosure, though it is seldom used.

For those of you that are homeowners, the next time you write that check for Mello Roos, realize that you are paying down the loan for the infrastructure around you. You didn?t think the developer absorbed those costs, did you? That would cut into profits.

Realistically, Community Facilities Districts do encourage private development by making marginal projects feasible. It keeps development in the hands of private individuals rather than municipalities developing their own roads, streets and utility systems. To the degree you believe these results are desirable, you should support Mello Roos.

Without the ability to develop marginal projects, supply is always lagging behind. The Community Facilities District Act does encourage development to lead into growing markets and blunt the impact of supply shortages. Despite the additional supply this law puts on the market, it has failed to prevent housing bubbles.

Determining Mello Roos

Property taxes and Mello Roos fees are deducted from a borrower?s available income to service cashflow, and thereby it reduces the amount they can finance. In essence, there is already a 30-year mortgage on the property you must pay off ? your portion of the Mello Roos ? so the purchaser money mortgage must be paid with left-over funds.

Builders and developers both know the impact of Mello Roos, so builders will pay less for lots with high Mello Roos fees because they know they will have to discount the purchase price of the final product in order to qualify any buyers. Developers want the Mello Roos fees to be as high as possible because the higher the fees, the greater the bond revenue developers receive. Builders want the Mello Roos to be as low as possible to give them competitive advantage. The resulting compromise usually puts Mello Roos at between 0.5% and 0.8% of total value.

The good news with Mello Roos is that the fees are fixed. As house prices go up, the Mello Roos fees become less burdensome to later buyers. If the Mello Roos are set at 0.8% of an initial $200,000 sales price, the same figure represents only 0.4% of a $400,000 resale price. Of course, the reverse is also true.

When the Irvine Company first opened Woodbury and Portola Springs, they were priced to the peak and they had maximum Mello Roos. Now that houses are selling for lower price points, the Mello Roos start to become onerous. If the original sale price of a condo was $400,000, and the Mello Roos were 0.8% of value, if the condo resells for $200,000, the Mello Roos now represent 1.6% of the purchase price. That is a stiff property tax bill by California standards.

Homeowners Insurance

Homeowners insurance protects the property owner against loss. It?s nearly always required by lenders because they want to protect the value of their collateral if they should need to foreclose on the property. Even if a lender doesn?t require it, the risk of catastrophic loss makes such insurance a necessity even for those who pay cash. Who would want to lose half a million dollars or more in a fire?

A standard policy insures the structure and documented personal property within. In addition, the package policy covers liability and legal responsibility for property damage caused outside the home itself by the owners, the members of the owner?s family, and even the family pets. Disaster damage is included, but this carries some exceptions, most notable here in California is earthquake damage, but damage due to floods and poor maintenance are also excluded. Seperate policies can be purchased to cover earthquake and flood damage, but these policies can be quite costly.

Homeowner Association Dues and Fees

Many modern planned communities have homeowners associations formed to maintain privately owned facilities held for the exclusive use of community residents. These HOAs bill the owners monthly to provide these services. They have foreclosure powers if the bills are not paid. It is given the authority to enforce the covenants, conditions, and restrictions (CC&Rs) and to manage the common amenities of the development. It allows the developer to legally exit responsibility of the community typically by transferring ownership of the association to the homeowners after selling off a predetermined number of lots. Most homeowners? associations are non-profit corporations, and are subject to state statutes that govern non-profit corporations and homeowners? associations.

California has many problems with condo associations that are poorly managed. These associations often underfund their reserves creating potential for costly assessments. This information can be difficult to find and analyze prior to a purchase. HOAs only provide their financials to potential buyers who are already in escrow, and these documents often appear at the last minute preventing any meaningful analysis. Even in circumstances when the documents are provided in a timely manner, most novices lack the time or sophistication to decipher the reports. Further, since these documents come so late in the process, many buyers who do discover problems end up going through with the transaction anyway because they are emotionally invested in the property.

Larry Hagman Never Considered Quitting Dallas Despite Cancer Battle; The Origins Of J.R. Explained

Larry Hagman passed away on Friday due to complications of his battle with cancer, but he never considered dropping out of the "Dallas" reboot when he was first diagnosed.

Back in May, the actor told AccessHollywood.com's Laura Saltman that despite his diagnosis, the show had to go on.

"No," Larry laughed, after Laura asked if he thought of just fighting his cancer and skipping out on TNT's "Dallas" series. "Well, I'd made the commitment before we found out and when we found out, they made allowances for it. They gave me a lot of time off. You don't get too many chances of pulling 'Dallas' back together again."

"I'm an actor, honey," he added. "I gotta do it. You may have pneumonia, but you go on stage anyhow." (Click HERE to watch that interview.)

Playing one of TV's most famous villains once again was a huge draw for the star to return to Southfork.

Correspondent Jill Martin visited the set of "Dallas" in 2011 for Access Hollywood and while Hagman's co-stars said he had little in common with the legendary character, the actor wasn't so sure.

"I must have something in common. I do it so well," he said. (Watch our interview with Hagman on the set of "Dallas" Season 1, by clicking HERE.)

Hagman went on to explain that the inspiration for the character came from someone he met when he was just a teenager.

"I modeled the character on a guy I knew that I worked for when I was 15 years old. His father had four boys and when he died, everything went to the struggle that these four guys were gonna do to get the mettle to run the company," Hagman continued. "One guy did and I modeled my character after him. His name is Jess Hall Jr. and he just passed away [in 2010] -- about 90 or something like that. Great guy and I worked for him for about two years and he just implanted this story of J.R. into me and when this role came around, I just went right straight to it. I knew exactly what to do."
